A company offers to deliver meals to the place of choice of its customers, workplace, home... One of the delivery men has a bicycle accident while delivering a customer. He claims indemnities and thus the status of employee. His colleagues join him to create a collective and thus claim the recognition of an employment contract binding them to the company.
Objectifs pédagogiques
- To understand the issues related to the evolution of the employment relationship
- To carry out a global societal reflection on this notion, it is important to understand the technical implications and their evolution and interpretation
- To master the concept of the employment contract, its characteristics and the criteria or indices that allow the identification of the employment relationship
- To differentiate between the taking into account of an external expense (if the courier is considered as self-employed) and an internai expense (if the courier is considered as employee)
